1. Acceptance of Terms

Welcome to Healfie. These Terms of Service ("Terms") govern your access to and use of the Healfie mobile application ("App"), including any content, functionality, and services offered through the App. By downloading, accessing, or using our App, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the App.

Please read these Terms carefully before using our App. If you are under the age of 18, you are not permitted to use the App or register for an account.

2. Description of Services

Healfie is a health monitoring application that provides tools and features to help users track and analyze various health metrics. The App offers personalized insights and recommendations based on the health data you provide or that is collected from connected devices or services.

Important Notice: Healfie is not intended to provide medical advice, diagnosis, or treatment. The App is designed for informational and educational purposes only. Always consult with qualified healthcare professionals regarding any medical conditions or before making any health-related decisions.

3. Data Storage and Privacy

We respect your privacy and are committed to protecting your personal data:

  • Local Data Storage: Our App is designed to store your health data locally on your device. This means your sensitive health information remains on your device unless you explicitly choose to share it.
  • Data Security: We implement appropriate technical and organizational measures to protect your personal information. However, no method of electronic transmission or storage is 100% secure, and we cannot guarantee absolute security.
  • AI Health Coach: Our App uses artificial intelligence technology provided by Anthropic (Claude) to power the 24/7 AI Health Coach feature. To provide personalized health guidance and insights, we share your health data and conversation context with this AI service. This includes health metrics, biomarkers, activity logs, and other health-related information you provide or that is collected through the App. The AI uses this information to generate personalized health recommendations.

By using the App, you consent to the data practices described in our Privacy Policy, including the sharing of your health information with our AI service provider to enable the health coaching functionality.

4. User Account and Responsibilities

When using Healfie, you agree to:

  • Provide accurate, current, and complete information when creating an account
  • Maintain the security of your account and password
  • Accept responsibility for all activities that occur under your account
  • Promptly notify us of any security breaches or unauthorized use of your account
  • Not use the App for any illegal or unauthorized purpose
  • Not attempt to probe, scan, or test the vulnerability of our systems or networks
  • Not interfere with or disrupt the integrity or performance of the App or its servers

5. App Store Terms

When you download our App through the Apple App Store, the following terms also apply:

  • These Terms are between you and Healfie, not with Apple
  • Your use of the App must comply with the App Store's Terms of Service
  • Apple has no obligation to provide maintenance or support services for the App
  • In the event of any failure of the App to conform to warranties, you may notify Apple, and Apple may refund the purchase price (if applicable) to you
  • Apple is not responsible for addressing any claims related to the App or your possession and/or use of the App
  • Apple is a third-party beneficiary of these Terms and may enforce these Terms against you

6. Subscription and In-App Purchases

Our App may offer subscription services and in-app purchases:

  • Payment for subscriptions and in-app purchases will be charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account will be charged for renewal within 24 hours prior to the end of the current period
  • You can manage and cancel your subscriptions by going to your account settings on the App Store
  • All purchases are final. We cannot issue refunds for purchases made through the App Store

7. Intellectual Property Rights

The App and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Healfie, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

These Terms permit you to use the App for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our App.

8. Health-Related Disclaimer

The content provided through the App is for informational and educational purposes only and is not intended to be a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition.

Do not disregard professional medical advice or delay seeking it because of something you have read or seen on the App. Reliance on any information provided by the App is solely at your own risk.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Healfie shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from:

  • Your use of or inability to use the App
  • Any actions we take or fail to take as a result of communications you send to us
  • Any unauthorized access to or use of our servers and/or any personal information stored therein
  • Any interruption or cessation of transmission to or from the App
  • Any bugs, viruses, trojan horses, or the like that may be transmitted to or through the App

10. Changes to Terms

We may revise and update these Terms from time to time at our sole discretion. All changes are effective immediately when we post them. Your continued use of the App following the posting of revised Terms means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the European Union and your country of residence, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
